What does a Qualified Intermediary do?
A Qualified Intermediary (QI) facilitates the exchange by preparing the exchange paperwork, coordinating with closings, and holding the sale proceeds so you don’t take “receipt” of the funds and accidentally create a taxable sale.
What is the 45-day rule in a 1031 exchange?
You must identify your replacement property(ies) in writing within 45 calendar days of selling your relinquished property—no extensions in most cases.
What is the 180-day rule in a 1031 exchange?
You must complete the purchase of at least one identified replacement property by the 180-day deadline (or earlier in some tax-filing situations), or the exchange can fail.
What property qualifies as “like-kind” for real estate?
For real estate, “like-kind” is broad: generally, real property held for investment or business can be exchanged for other real property held for investment or business (not a primary residence).
